Auchengool House Holiday Let Self Catering Terms & Conditions
Acceptance of Terms & Conditions: When we confirm the booking you have made with us, it is assumed that you have read these terms and conditions and agree to them.
When we have received the required deposit to secure the booking we will provide a written email confirmation of your booking. A legally binding Contract of Hire then exists between us that is non-cancellable and non-refundable, except in exceptional circumstances.
The Contract of Hire is governed by Scottish law and jurisdiction and is not effective until written email confirmation of the booking has been provided to the Hirer. The contract is for the hire of the property for holiday purposes only. We do not accept bookings from Hirers under 21 years of age.
In the event of any dispute between parties, it shall be referred to the jurisdiction of the Scottish courts and shall be governed by Scottish law and jurisdiction.
Prices: Prices are shown on our website www.auchengoolhouse.co.uk with a minimum 3 day booking. Prices vary according to seasonality.
Number of Guests: Auchengool House can accommodate a maximum of 10 people in five bedrooms. Under no circumstances may more than the maximum number of persons occupy the property. We reserve the right to ask any unauthorised visitors to leave the property.
Reservations and Deposit: Bookings at Auchengool House will be confirmed upon receipt of a deposit equivalent to 30% of the total holiday cost. We accept payment by cash, bank transfer or debit/credit card. Payment can be made through the booking system on our website www.auchengoolhouse.co.uk or directly with us.
The full balance is payable 8 weeks prior to the holiday start date. Auchengool House reserves the right to cancel a holiday where full payment has not been received 8 weeks before the start date. Bookings made within 8 weeks of the holiday start date are payable in full on booking.
Auchengool House reserves the right to refuse to accept bookings from parties consisting solely of young adults. The Hirer should make the nature of the group known when booking.
Covid- 19: Our Covid- 19 policy is to guarantee a full refund should re-imposed Scottish or UK government restrictions prevent you from visiting Auchengool House, but not in the case of quarantine requirements or if you are infected yourselves. For the latter eventualities, there is now insurance cover available through most reputable travel insurers and we recommend that such cover is taken out at the time of booking.
Please do not travel to Auchengool House if you or any of your party has symptoms of Covd-19, stay at home and follow Government guidelines for self-isolation. If at any time during your stay you develop symptoms of Covid-19 (high temperature, persistent cough, loss of smell or taste) or are informed by Track & Trace (England) or Test and Protect (Scotland) staff that you must isolate then you must inform us immediately, check out and return home.
If you develop acute symptoms please dial 999 and inform us immediately. If you become ill within 14 days of returning home, please let us know.
Cancellation: Except as stated above in respect of Covid- 19, for cancellation within 8 weeks of the planned start date, the Hirer shall be held responsible for the full rental fee unless Auchengool House can re-let the house, in which case a refund will be made, less a deduction for costs incurred. Cancellation greater than 8 weeks from the planned start date will result in loss of deposit. Cancellations must be notified in writing by email. We suggest that guests take out adequate travel insurance to cover unforeseen cancellations.
Where deposits are paid by debit/credit card, it is agreed between the parties that in the event of cancellation, we may debit the guests debit/credit card with the full amount of the cancellation.
Arrival and Departure Time: Bookings begin at 4pm on arrival day and end at 10am on departure day.
Damages, Breakages or Theft: The Hirer is responsible for the property and is expected to take all reasonable care. All accommodation and utensils must be left clean and tidy at the end of the hire period. An additional charge may be made for cleaning if the house is not left in a clean and tidy condition. All breakages or damage to the property, fixtures, fittings or equipment caused by the Hirer or any member of their party must be reported promptly. Please report these as soon as they occur. We do not normally charge for minor damage or breakages, but we reserve the right to make a charge to the Hirer’s credit/debit card, or we may send you an invoice for repair or making good if the damage or breakage is significant. We may make an additional charge if you do not report this. Theft of any items will be charged. The person making the booking certifies that they agree the terms and conditions on behalf of all members of their party.
The Hirer shall ensure that the holiday accommodation is securely locked when not occupied during the period of the holiday let and shall ensure that all keys are left at the property on departure. Failure to comply with this term may result in an additional charge being made.
The Hirer shall undertake to prevent any member of his party from causing a nuisance or disturbance to neighbours. In the event of a problem arising, the Owner has the right to ask the Hirer and his party to leave.
The Hirer agrees to allow the property Owner and its agents reasonable access to the property.
Our Liability: Limited liability. Save in respect of any death or personal injury claim caused by the negligence of the Property Owner, the Property Owner cannot accept liability for any damage, expense or loss of any nature whatsoever suffered by any person(s) from any cause whatsoever.
Save in respect of any death or personal injury claim caused by the negligence of the Property Owner, any other liability of the Property Owner under this Agreement shall be limited to the rental value of the relevant booking at the Property.
The Property Owner shall not be liable to you for any loss of profit, consequential loss or other indirect losses under the terms of this Agreement.
The use of the accommodation and amenities at Auchengool House is entirely at the user’s risk. No responsibility can be accepted for loss, damage or injury to users or their belongings. We do not accept liability for damage, loss or injury to any member of your party or any vehicles or possessions, unless proven to be a negligent act by ourselves or our contractors whilst acting in the course of employment.
We may terminate our contract with you and ask you to leave the accommodation immediately (without any compensation being payable) if we consider that you or your party have committed a serious breach of these terms and conditions. Or if we consider that you or your party’s behaviour endangers the safety of our ourselves, our neighbours or staff. Or any complaints are made of anti-social behaviour or unacceptable behaviour against you or your party. Or you or your party cause an unreasonable amount of damage to the property or its contents. Or if you exceed the maximum occupancy limit for your accommodation.
Non-Availability: We would only cancel your booking if your accommodation was unavailable for reasons beyond our control. In this instance, we would refund all monies paid by you. Our liability would not extend beyond this refund.
Other Terms & Conditions: Smoking is not permitted anywhere inside the house.
There are no additional charges for linen, electricity, heating and water services. A starter pack of logs is provided with further logs available from local shops.
Animals: Guests are not permitted to bring any pets or leave pets in cars. Registered assistance dogs are of course welcome.
Data: Any data gathered during the course of your booking may be held on our computer. Unless you request otherwise, we will store your name and email address in order that we can give you occasional updates on Auchengool House with news and offers. Your details will not be given to any third party.
